JUDGMENT : DAYA CHAUDHARY, J. 1. Civil Misc. Application No.8722 of 2016 has been moved for stay of impugned order of transfer (Annexure P-1). 2. The main case is fixed for 19.09.2016. 3. Though the petitioner has already retired from service on 31.07.2016, the date in the main case is preponed and is taken up for hearing today itself. 4. The prayer in the main petition is for quashing of impugned order of transfer dated 31.05.2016 (Annexure P-1), whereby, the petitioner has been transferred from Barnala to Ludhiana. 5. The argument of learned counsel for the petitioner is that the petitioner is retiring from service on 31.07.2016 and his transfer in place of respondent No.4 is contrary to the policy. Certain other arguments have also been raised that an assurance was given to the petitioner to first join his duties at Ludhiana and thereafter, his transfer would be cancelled but subsequently, he has retired. 6. Since the petitioner has retired from service on 31.07.2016, learned counsel for the petitioner wishes to withdraw the present petition as well as the application for stay of impugned order. 7. The application as well as main case are dismissed as withdrawn.
