JUDGMENT : Petition filed under Section 397 and 401 of Criminal Procedure Code, praying this Court to call for the records relating to the order dated 25.10.2013 made in Cr.R.P. 25 of 2012 on the file of the District Sessions Court, Dindigul and set aside the same by allowing the above Criminal Revision Petition and modifying order dated 14.09.2012 made in MC No. 1 of 2010 on the file of the Judicial Magistrate, Palani Order : This case coming on for hearing on this day, upon perusing the grounds of petition, typed set of the case and the order of the Courts below and upon hearing the arguments of M/S. ANANTH C. RAJESH, Advocate for the petitioners and of Mr. M.P. Senthil, Advocate for the Respondent, this court made the following order:- It is represented by the Learned Counsel Ms. M. Surya, on behalf of the petitioners that this Court on 03.09.2015 in Crl.R.C.(MD). No. 180 of 2014 (filed by the Revision Petitioners) had passed the following order: "A calculation memo has been filed giving the details of arrears of maintenance to be payable by the husband. The total arrears of maintenance comes to Rs.4,91,500/-. Out of the arrears of Rs.4,91,500/- a sum of Rs.1,00,000/- shall be deposited before this Court within a period of 15 days, from today, by the husband. Post after 15 days." 2. Today, when the matter has come up for hearing, the Learned Counsel for the Revision Petitioners brings it to the notice of this Court that the Respondent/Husband had paid only a sum of Rs.50,000/- in cash to the Revision Petitioners and till date, he has not complied with the order passed by this Court on 03.09.2015 in Crl.R.C.(MD) No. 180 of 2014 in full and also in true letter and spirit. 3. In view of the fact that the Respondent/Husband till date has not complied with the order passed by this Court in Crl.R.C. (MD) No. 180 of 2014 dated 03.09.2015 in full and has only paid a sum of Rs.50,000/- in cash to the Revision Petitioners (as informed by the Learned Counsel for the Petitioners), this court deems it fit and proper to grant some time to the Respondent/Husband to pay the remaining sum of Rs.50,000/- (Rupees fifty thousand only) to the petitioners. Viewed in that perspective, this Court grants time to the Respondent/Husband to pay the balance sum of Rs.50,000/- to the Revision Petitioners on or before 02.02.2016. 4. The Registry is directed to list the matter on 03.02.2016.
