JUDGMENT : Sudhanshu Dhulia, J. (Oral) Heard Mr. Deep Chandra Joshi, Advocate present for the revisionist/applicant and Mr. K.S. Rautela, learned Government Advocate assisted by Mr. H.S. Rawal, A.G.A. present for the State. The present revisionist has been convicted by the learned Additional Chief Judicial Magistrate (Railway), Haldwani under Section 160 (2) of Railways Act,1989 and sentenced for one year rigorous imprisonment. Aggrieved, an appeal was filed before the learned Ist Additional Sessions Judge, Haldwani, District Nainital which was dismissed and it has confirmed the order of learned Additional Chief Judicial Magistrate (Railway), Haldwani. Hence, the present Criminal Revision before this Court. This matter has been listed before this Court on an Urgency application moved by the revisionist/applicant in pending Criminal Revision. This Court is the opinion that the Urgency application is liable to be allowed and the same is allowed. Heard on Bail application No.2191 of 2015. Considering the fact that the revisionist was on bail during the trial as well as in appeal and he is in jail since 15.12.2015, this Court is inclined to grant interim bail to the revisionist for a period of five weeks i.e. upto 25.02.2016. Let the revisionist be released on interim bail only upto 25.02.2016 in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Magistrate/court concerned. Summon the lower court records. List this matter on 22.02.2016 in the daily cause list. The revisionist after release on interim bail shall be present before this Court on the next date of listing.
