JUDGMENT : A.B. CHAUDHARI, J. 1. Heard learned counsel for the rival parties. 2. In FIR No. 0012 dated 18.02.2016, the petitioners are incarcerated. Pursuant to the order dated 29.04.2016, statements of both the parties, in view of the compromise arrived at, have been recorded and they were found to be correct and genuine. This Court has received report from the Sub Divisional Judicial Magistrate, Sunam. 3. So far as damage to the public property is concerned, the record shows that the petitioners have tried to take possession of the common land and nothing beyond that. In that view of the matter and in view of compromise arrived at between the parties, which has been found to be genuine and without any pressure or influence, I am inclined to accept the instant petition. The petition is allowed and FIR No. 0012 dated 18.02.2016 is quashed qua the petitioners only, along with subsequent proceedings arising therefrom.
