JUDGMENT : ANJANA PRAKASH, J. 1. Appellants have been convicted under Sections 302 and 120-B of the Indian Penal Code and sentenced to rigorous imprisonment for life and under Sections 225 and 353 of the Indian Penal Code and sentenced to rigorous imprisonment for two years under both counts by the Additional District and Sessions Judge, Fast Track Court-II, Gaya, vide Judgment of conviction dated 12.01.2010 and Order of sentence dated 18.01.2010 passed in Sessions Trial No. 240 of 2009/89 of 2009(ADJ-I)/551 of 2004 (DJ). 2. The case of the prosecution, according to the Fardbeyan of the Informant Laxmi Mukhiya (P.W.7), is that on 12.05.2004 in course of production from court hazat, Appellant Md. Aslam alias Aslam Mian Arbind Mahto and Daldal Mian pushed the constable Biswanath Ram (P.W.8) on account of which he fell down. Thereafter, they started to flee. Just at that time, sound of bomb explosion was heard outside the boundary wall of the Civil Court in front of Hazat and shots of fire was also heard. There was panic amongst the people, in course of which, some under trials managed to flee away, however, they were chased. They arrested one Firoz Alam, who was pointed out as the person who was throwing the bomb. On checking, it was found that seven under trials, i.e., Appellants Aslam Mian, Uday Paswan, Sanjay Mishra alias Luccha Mishra and Rajesh Kumar Manjhi as also Daldal Mian, Santosh Sao and Arbind Kumar Mahto, had managed to run away but Appellants Aslam Mian, Uday Paswan and Sanjay Mishra alias Luccha Mishra were caught immediately. Thereafter, one person, who was found injured, was removed to the hospital but he died on the way. 3. During trial, the prosecution examined altogether 11 witnesses. 4. P.W.4 Surendra Kumar, cousin brother of the deceased Dilip Kumar, P.W.5 Banke Prasad, father of the deceased Dilip Kumar and P.W.6 Pradeep Kumar, a relative of the deceased Dilip Kumar, are merely on the point of the death of the deceased. P.W.11 Dr. Anand Prasad performed the post-mortem examination of the deceased and found the deceased Dilip Kumar having sustained firearm injuries and cause of death was the same. 5. P.W.1 Sheo Ram has stated that on the date of occurrence he was a constable posted in the Civil Courts whereas Biswanath Ram (P.W.8) was In-charge of the court hazat.
P.W.11 Dr. Anand Prasad performed the post-mortem examination of the deceased and found the deceased Dilip Kumar having sustained firearm injuries and cause of death was the same. 5. P.W.1 Sheo Ram has stated that on the date of occurrence he was a constable posted in the Civil Courts whereas Biswanath Ram (P.W.8) was In-charge of the court hazat. While Biswanath Ram was trying to take out the under trials by opening the door, he was pushed by them. Appellant Aslam Mian is the person who pushed him first and then rest did so. Biswanath Ram then fell down at which under trials started to run. Appellant Aslam Mian was once again first person to do so. However, P.W.2 Laxmi Narain Jha immediately caught him. 6 or 7 under trials ran away. He also heard sounds of explosion of bomb and death of one person. Out of the absconding under trials, 3 or 4 of them were caught but he could not remember their names but he identified the Appellant Aslam Mian as also surprisingly Firoz Alam, who was not under trial at the relevant point of time. There is nothing which is notable in his cross examination except that he did not attend the Test Identification Parade or that he did not state before the police about the manner of occurrence and Biswanath Ram having fallen down and that Appellant Aslam Mian was the first to run. 6. P.W.2 Laxmi Narain Jha was also a constable posted in the Civil Court premises on that particular date and stated that while the under trials were taken out from the court hazat and controlled by constable Biswanath Ram, he was putting handcuffs on them. As soon as the second under trial came out, he pushed Biswnath Ram on account of which he fell down. Appellant Md. Aslam @ Aslam Mian was the first person to run but he was immediately caught. A scuffle took place between them but he was detained and handed over to the police. He further stated that he heard sounds of explosion of bomb and later learnt that one person had been shot dead and two of the under trials, namely, Sanjay Mishra @ Luccha Mishra and Uday Paswan had been caught by the police who arrived immediately thereafter.

His attention was also drawn in cross-examination with regard to the earlier statement that he had not stated that Appellant Aslam @ Aslam Mian was first to run. 7. P.W.3 Narendra Kumar Paswan was also a constable posted at the court hazat but he did not support the case of prosecution to the extent that he did not name any of the accused and was declared hostile. 8. P.W.7 Laxmi Mukhiya is the informant, who stated that on 12.05.2004 while the under trials were kept in the court hazat and Biswanath Ram (P.W.8) was the In-Charge, he raised alarm that under trials were running away. They then rushed towards hazat and found him fallen down and hazat door opened. He immediately locked the hazat door. He was told that some under trials had run away and then he found Appellant Md. Aslam @ Aslam Mian having been caught by P.W.2 Laxmi Narain Jha. He also heard sound of explosion of bomb and firearm shots and learnt that one person had been injured who died on way to the hospital. On checking of the records, he found that under trials were Appellants Md. Aslam, Sanjay Mishra alias Luccha Mishra, Uday Paswan alias Tiwary Paswan and Santosh Rawani, Arbind Kumar and Appellant Rajesh Kumar Manjhi and Daldal Mian. He stated that Appellant Aslam Mian was caught by P.W.2 whereas Appellants Uday Paswan and Sanjay Mishra were also caught. He stated that no incriminating article was recovered from the person of any of the fleeing Appellants. He also conceded that he did not see Appellant Aslam Mian running from the court hazat. 9. P.W.8 Biswanath Ram, who was most important witness and custodian of the under trials in the court hazat, has been declared hostile on the point of naming the under trials who had run away and were caught. 10. Hasan is a witness on the point that the person Firoz Alam, who had been caught at the place of occurrence, but, in fact, he had gone to attend the case in Civil Courts. 12. Two witnesses, namely, Janardan Prasad Singh and Veer Singh Harsha, have been examined by the Court. 13. C.W.1 Janardan Prasad Singh was posted in the Civil Lines Police Station on 12.05.2004 and at 01.30 P.M. he had recorded the Fardbeyan of Laxmi Mukhia (P.W.7). He proves his signature on the Fardbeyan which was earlier marked as Ext.2 and on the First Information Report, which was marked as Ext.1/4. He confirms the institution of the case and his signature on the same as Ext.2/1. He merely stated that when he reached the hazat, the police force had caught four persons, namely, Appellants, Aslam Mian, Uday Paswan, Sanjay Mishra and one Firoz Alam. He also stated that one person was found injured within the Civil Courts Campus, who was taken to the Hospital but he died on the way. 14. C.W.2 Veer Singh Harsha was also posted at the Civil Lines Police Station, Gaya, as ASI and had assumed investigation of the present case. He proves his signature on the Inquest Report as Ext.1/2. He stated that he proceeded to the place of occurrence, inspected the same as also examined the witnesses. He also submitted the Charge-sheet against the present Appellants. In cross examination, he stated that he had not noted as to under which case, Appellant Rajesh Kumar Manjhi had been kept in custody nor did he note the particulars of the cases in which the present Appellants were facing trial. He also did not find any signs of bomb explosion or firearms at the place of occurrence nor did he learn as to who shot the deceased. He stated that P.W.1 had not stated before him that Appellant Aslam Mian had firstly pushed on account of which he and Biswanath Ram (P.W.8) had fallen down or that Aslam had run first. Laxmi Narain Jha (P.W.2) had also not stated that it was Appellant Aslam who had run first and there was scuffle between him and Md. Aslam.
He stated that P.W.1 had not stated before him that Appellant Aslam Mian had firstly pushed on account of which he and Biswanath Ram (P.W.8) had fallen down or that Aslam had run first. Laxmi Narain Jha (P.W.2) had also not stated that it was Appellant Aslam who had run first and there was scuffle between him and Md. Aslam. He merely stated that Appellant Aslam had not been caught in the court hazat while running away. 15. On fair assessment of the evidence of the witnesses which we have reproduced above, we find that there is complete absence of any evidence to connect the present Appellants with the murder of Dilip Kumar and hence they are acquitted of the charges under Sections 302/341 of the Indian Penal Code. 16. We also find that the prosecution has not brought any documentary evidence which alone could testify that the Appellants were indeed under trials on the date of occurrence. As for their trying to escape from custody, we find that the evidence in this regard is shaky. P.W.1 has only stated about Appellant Aslam being the first person who pushed P.W.8 Biswanath Ram but this fact was not stated by him before the Investigating Officer. P.W.2 who stated that he had caught hold of Appellant Aslam does not say as to how far from the court hazat he had caught him. No witness has stated about the Appellants Rajesh and Sanjay. The manner of occurrence as depicted that bombs were exploded near the hazat could also have led to a stampede in order to save their lives. Taking all these into consideration we are inclined to hold that there is no evidence to justify the conviction of the Appellants under Sections 225/353 of the Indian Penal Code and hence they are acquitted of the said charges. 17. For the aforesaid reasons, these Appeals are allowed. The Judgment of conviction and order of sentence passed against the Appellants, above named, are set aside. They are acquitted of the charges. Appellant Md. Aslam @ Aslam Mian [in Criminal Appeal (DB) No. 216 of 2010] is in jail custody. Therefore, he is directed to be released forthwith, if not wanted in any other case.
The Judgment of conviction and order of sentence passed against the Appellants, above named, are set aside. They are acquitted of the charges. Appellant Md. Aslam @ Aslam Mian [in Criminal Appeal (DB) No. 216 of 2010] is in jail custody. Therefore, he is directed to be released forthwith, if not wanted in any other case. So far as Appellant Sanjay Mishra @ Luccha Mishra [in Criminal Appeal (DB) No. 253 of 2010], Appellant Rajesh Kumar Manjhi [in Criminal Appeal (DB) No. 325 of 2010] and Appellant Uday Paswan @ Tiwari @ Uday Paswan @ Tiwari Paswan [in Criminal Appeal (DB) No. 774 of 2014] are concerned, they are on bail. Therefore, they are discharged from the liabilities of their bail bonds. Appeals allowed.
