ORDER P.S. Rana, Judge (Oral) Present petition is filed under Section 397 of Cr. P.C. against the orders dated 2.12.2015 and 15.12.2015 passed by the learned JMIC Court No.2 Kasauli H.P. in Case No. 70 of 2011 titled M/s Prontos Private Limited Vs. M/s Shri Guru Hargobind Steel Industries Guru Ki Nagri, Mandi Gobindgarh and others. With the consent of parties following orders are passed:- 1. Revisionists intend to prove documents. Revisionists will place certified copy of documents proposed to be proved before learned trial Court on or before 28th March 2016. If proposed documents are filed within stipulated period then official witnesses mentioned in the list of witnesses will be summoned in accordance with law. If witnesses will not appear before learned trial Court despite service then coercive method i.e. bailable warrants or non-bailable warrants will be issued against witnesses(s) by learned trial Court in accordance with law. 2. Learned trial Court will record the testimonies of official witnesses within four weeks after receipt of file. 3. Any prior costs imposed upon accused persons will be recovered prior to recording evidence of accused persons. Accused persons will be at liberty to adduce any other private witnesses at their own responsibility on the day of evidence of accused persons. 4. Parties are directed to appear before learned trial Court on 28.3.2016. Registrar (Judicial) will ensure that the file of learned trial Court along with certified copy of this order should reach before learned trial Court before 28.3.2016.Order passed in the ends of justice with consent of learned Advocates. 5. Orders of learned trial Court dated 02.12.2015 and dated 15.12.2015 are modified to this extent only with consent of learned Advocates. Observations will not affect merits of case in any manner. Petition disposed of. Pending applications if any also disposed of.
