2016-05-13

K.M.JOSEPH, V.K.BIST

body2016
JUDGMENT : K.M. Jospeh, J. Petitioner seeks the following relief: “I. Issue a writ order direction in the nature of Mandamus directing the respondents to permit the petitioner to deposit the examination fee and examination form of Uttarakhand Judicial Service Civil Judge (J.D.) Mains Examination.” 2. Petitioner applied pursuant to advertisement issued by the Public Service Commission dated 20.10.2015. The last date for submission of the fee was 03.05.2016. Admittedly, petitioner could not deposit the amount, according to him. The petitioner is actually employed in the Police Department as a Sub Inspector and, as such, he could not gather the knowledge of last date for submission of fee, which was 03.05.2016. The last date of submission of the application form is 13.05.2016 (today). 3. We heard Mr. Bilal Ahmed, learned counsel for the petitioner and also Mr. B.D. Kandpal, learned counsel for the Uttarakhand Public Service Commission. 4. Learned counsel for the Uttarakhand Public Service Commission would point out that in the advertisement, it was made clear that the non-payment of fee on or before the last date or non-submission of the application form on or before the last date will entail rejection by the Public Service Commission. 5. In the admitted facts of this case, we would not think that it will be appropriate for this Court to entertain this writ petition. Accordingly, the writ petition stands dismissed. 6. There will be no order as to costs.
