JUDGMENT : DAYA CHAUDHARY, J. 1. Prayer in the present writ petition filed under Articles 226/227 of the Constitution of India is for issuance of a writ in the nature of certiorari for quashing of order dated 25.05.2015 passed by respondent No.3, whereby, cut of 10% from the pension of the petitioner has been imposed for two years. A further prayer has also been made for issuance of a writ in the nature of mandamus directing respondent No.1 to decide the appeal filed by the petitioner. 2. Learned counsel for the petitioner submits that the petitioner retired from service on 31.07.2008 and impugned order has been passed on 25.05.2015 i.e., after about seven years of his retirement. An appeal against said order was filed on 10.07.2015 but the same is still pending. Learned counsel also submits that the petitioner would be satisfied in case, directions are issued by this Court to decide the appeal filed by him. 3. Keeping in view the limited prayer of the petitioner, the present writ petition is disposed of with a direction to respondent No.1 to consider and decide the appeal filed by the petitioner within a period of four weeks from the date of receipt of certified copy of this order. 4. However, in case, any appeal is pending for any unavoidable reason, there shall be stay of recovery from the petitioner till the same is decided.
