JUDGMENT : Daya Chaudhary, J. Prayer in the present writ petition is for quashing of letter dated 19.11.2013 (Annexure P-12) to the extent that only those Junior Draftsmen, who are possessing the qualification of two years diploma, have been called for consideration for promotion to the post of Draftsman. A further direction has also been sought to be issued to the respondents to consider the claim of the petitioners for promotion as Draftsman keeping in view their seniority in the feeding cadre of Junior Draftsman and also in view of the fact that the condition of two years diploma for promotion to the post of Draftsman has already been waived off in another department of State Government. 2. Learned counsel for the petitioners submits that the case of the petitioners was recommended by the Chief Engineer, Irrigation Department, Punjab still they are not being considered. Subsequently, under the Rules, the qualification has been amended whereas the petitioners were appointed under the old Rules of 1997. Learned counsel also submits that the petitioners would be satisfied if, the case of the petitioners is considered in view of the recommendations made by the Chief Engineer by treating this petition as representation. 3. In view of the submissions made by learned counsel for the petitioners, the present writ petition is disposed of with a direction to respondent No.1 to consider the claim of the petitioners in view of the recommendations made by the Chief Engineer and also the averments made in the present writ petition in accordance with law within a period of three months from the date of receipt of certified copy of this order. 4. In case, the petitioners are found to be entitled for the relief sought, the same be granted to them and in case, the petitioners are still aggrieved, they are at liberty to avail the appropriate remedy. 5. Disposed of accordingly.
