JUDGMENT : P.B. BAJANTHRI, J. 1. The petitioner is stated to be working as a Personal Secretary to Deputy Commissioner, Gurgaon. Higher authorities to Deputy Commissioner, Gurgaon noticed that allotment of residential accommodation to the petitioner was not in accordance with law therefore, the higher authorities to the Deputy Commissioner directed the Deputy Commissioner to cancel the allotment of Government accommodation to the petitioner. Accordingly, on 11.7.2016, the Deputy Commissioner, Gurgaon asked the petitioner to vacate the Government accommodation allotted to her on 28.12.2015. On the face of Annexure P-1 it is evident that the Deputy Commissioner, Gurgaon has abused his powers while allotting the Government accommodation to the petitioner. Merely petitioner is his/her Personal Secretary which seems to be out of turn. Therefore, there is no infirmity in Annexure P-4 dated 11.7.2016. The petitioner has not made out a case so as to interfere with the Annexure P-4 dated 11.7.2016. 2. However, this order will not come in the way of the petitioner to approach the Head of the Organization for continuation of her stay in the allotted quarter till December, 2016. If the Head of the Organization has statutory powers, he may consider in accordance with law. CWP stands disposed of.
