ORDER 1. Legality and correctness of order dated 22.8.2014 passed by Joint Registrar, Cooperative Societies, Morena in exercise of his jurisdiction under section 80-A of the Madhya Pradesh Cooperative Societies Act, 1960, (for short “the Act”), has been challenged before this Tribunal on the precise ground that not having jurisdiction to pass any stay order, the learned Joint Registrar has ventured to pass any order by way of the impugned order. Therefore, the order being without jurisdiction, cannot be sustained. 2. Arguments heard. 3. With the consent of the learned counsel for both the parties that matter is being disposed of finally at motion stage itself. 4. The legal position is well settled that Joint Registrar or for that matter Registrar or Additional Registrar have no power to grant stay or interim injunction while exercising jurisdiction under section 80-A of “the Act”. (See Ram Singh v. Dinesh Ambedkar [1999 RN 64 (HC)=2000(2) MPLJ 94]. By way of the impugned order, the learned Joint Registrar has stayed the operation of order dated 1.3.2014 whereby Satendra Singh Jadon was removed from the post of Manager. Clearly the order is beyond jurisdiction and, therefore, on this precise ground, is liable to be set aside. 5. In view of the aforesaid, the revision succeeds and the impugned order is hereby set aside. 6. As the matter is pending before the Joint Registrar since long, we expect that the hearing is expedited and the matter is disposed of as early as possible. No order as to the costs.
