ORDER : 1. This writ petition is filed challenging the order of the first respondent, dated 29.09.2014, directing the Thakkar already appointed to take charge immediately in respect of the Arulmighu Subramaniyaswamy Kovil, Vayaloor. 2. The petitioner who claimed to be a trustee of the said temple challenged the impugned order by raising very many grounds including the violation of principles of natural justice. 3. This Court, by an interim order, dated 17.02.2014, directed the parties to maintain status quo till 30.10.2014. Thereafter, the matter was listed on 23.06.2015 and again today before this Court for final disposal of the writ petition. One of the contentions raised by the writ petitioner is that the application in O.A.No.59 of 1986 filed by the impleaded 3rd respondent herein for framing the scheme is pending before the first respondent and therefore, there is no necessity to appoint the Fit Person to maintain the temple. 4. Heard the learned counsel appearing on either side. 5. It is not in dispute that in respect of the subject matter temple, an application filed in O.A.No. 59 of 1986 is pending before the first respondent for framing the scheme. Therefore, this Court is of the view that instead of going into the rival contention of the parties and deciding the matter in respect of the appointment of the Fit Person, it would suffice, if the said O.A.No.59 of 1986 filed for framing the scheme is directed to be disposed of within time framed, so that the rights of the parties can be finally decided in the abovesaid proceedings. 6. Accordingly, without expressing any view on the rival contention raised by the respective parties, I only direct the first respondent to dispose of the application in O.A.No.59 of 1986 on merits and in accordance with law, after hearing all the parties concerned, within a period of eight weeks from the date of receipt of a copy of this order. Till an order is passed by the first respondent in the above original petition in O.A.No.59 of 1986, the status quo as on today prevailing should be maintained by both the parties. 7. With the above directions, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
