JUDGMENT Ram Surat Ram (Maurya),J. Heard Sri Ashok Kumar Singh for the petitioner and Sri Rakesh Kumar Shukla holding brief of Sri Dharm Vir Jaiswal for the respondents. 2. The writ petition has been filed against the order of Additional Director of Consolidation, U.P. (Technical), Lucknow dated 24.5.2016 rejecting transfer application of the petitioner for transferring Appeal No.592/976 (Bhawan Sri vs. Ram Murat) pending before the Settlement Officer, Allahabad. 3. In the appeal before the Settlement Officer, Consolidation the petitioner is respondent. The transfer application was filed before the Director of Consolidation, U.P. Lucknow on the allegation that Om Prakash Anjor, who is at present Settlement Officer, Consolidation has purchased a part of disputed land in the name of his mother Smt. Rajeswari Shastri wife of Shiv Bachan Ram Shastri and his brother Satya Prakash Anjor, who is at present posted as Consolidation Officer, Kashambi has also purchased land in disputed land. The petitioner has moved an application before the Settlement Officer, Consolidation for impleading pendente lite transferee as respondent in the appeal but he is not taking any interest in passing any order in the impleadment application of the petitioner. The petitioner has also moved another application for dismissing the appeal on the ground of maintainability but it has also been avoided by the Settlement Officer, Consolidation. Thus, Settlement Officer, Consolidation, Allahabad is under pressure of the interested officers of consolidation department and he has no hope of justice from the Settlement Officer, Consolidation, Allahabad and the appeal be transferred from the court of Settlement Officer, Consolidation, Allahabad to any court of competent jurisdiction in another district. The allegation made in the application for transfer was not found to be substantive allegation, accordingly, the transfer application was rejected by the impugned order. 4. I have considered the arguments of the counsel for the petitioner. 5. Apart from the fact that two sale deeds have been executed -one sale deed was obtained by Om Prakash Anjor in the name of his mother Smt.Rajeshwari Shastri and other sale deed was obtained by his brother Satya Prakash Anjor, who is posted as Consolidation Officer, Kaushambi, there is no allegation that Om Prakash Anjor or his brother ever approached Settlement Officer, Consolidation, Allahabad for deciding the case in their favour.
Thus the ground that sale deeds have been executed in favour of employees of the consolidation department will not be accepted for transferring the appeal from the court of Settlement Officer, Consolidation. The writ petition has no merit and it is dismissed.
