ORDER : Mr. Arun Bhansali, J. This writ petition has been filed by the petitioner seeking a direction to the respondent-University to rectify the mark-sheet of the petitioner of IInd year, IIIrd year and IVth Year of BPT Course, while indicating her date of birth as 30.09.1985 and Registration No. A5P1606976. 2. It is, inter alia submitted in the writ petition that date of birth of the petitioner is 30.09.1985, which is apparent from the Secondary School Examination-2002 Certificate (Annex-1). The petitioner took admission with respondent No.1-University for her BPT Course while for the 1st year, the mark sheet indicates petitioner's date of birth as 30.09.1985 along with Registration No. A5P1606976, for the subsequent years the date of birth and the registration No. A5P1606979 and date of birth have been wrongly indicated as 09.03.1985 instead of Registration No. A5P1606976 and date of birth as 30.09.1985. 3. It is further submitted that despite repeated attempts made by the petitioner, the respondent-University has not corrected the dates in the mark-sheets and have not issued correct mark-sheets for the IInd year, IIIrd Year, IVth Year respectively. 4. Despite service, no one has appeared on behalf of the respondent No.1. 5. Learned counsel appearing for respondent Nos. 2 and 3, have no objection, in case, the petition filed by the petitioner is accepted in view of the mark-sheet issued by the Board of Secondary Education, Rajasthan (Annex-1). 6. I have considered the submissions made by learned counsel for the parties and have perused the material available on record. 7. From the perusal of the mark-sheet (Annex-1) issued by the Board of Secondary Education, Rajasthan for petitioner's Secondary School Examination, 2002, it is apparent that petitioner's date of birth is 30.09.1985 and the same was indicated in the 1st year mark-sheet, however, in the subsequent years the same has apparently been wrongly indicated as 09.03.1985 and the registration No. A5P1606979 which is also incorrectly indicated. 8. As no one has put in appearance on behalf of the respondent No.1, no reason is forthcoming for the said date of birth in the IInd year, IIIrd year, IVth year and, therefore, the same can only be termed as mistaken and the respondent 3 University is bound to correct the same as to bring it in sync with the petitioner's correct date of birth and the mark-sheet of Ist year issued by the respondent No.1-University itself. 9. 9. In view of the above discussion, the writ petition is allowed. The respondent No.1 is directed to issue fresh mark-sheets for the year IInd, IIIrd and IVth Year BPT of the petitioner by indicating her date of birth as 30.09.1985 and Registration No. A5P1606976, within a period of 15 days from the date of this receipt of certified copy of this order.
