JUDGMENT : AJIT SINGH, J. The State Government vide Notification bearing No. FSA 94/2000/73 dated 16.8.2001 formulated guidelines for selecting the nominee for allotment of salt rakes for bringing iodized salt to the State of Assam from outside under the Zonal Quota and also for distributing the same through the Public Distribution System. For the year 2014-2015, the Director of Food, Civil supplies and Consumer Affairs, Assam issued a Tender Notice published in the issue dated 14.2.2015 of ‘The Assam Tribune’ inviting applications from experienced traders. The appellants claiming themselves to be experienced traders participated in the tender process but their tenders were not accepted on the ground that they did not fulfill the minimum requirement of having financial transaction above Rs. 80 Lakhs. Aggrieved, the appellants filed WP (C) No. 5772/2015 which the learned Single Judge has dismissed by the impugned order dated 4.11.2015. The learned Single Judge has upheld the decision of respondents that the trader must have the minimum financial transaction of above Rs. 80 lakhs. Dissatisfied with the order passed in the writ petition, the appellants have filed the present appeal. It is to be noted that tenders were called for the financial year 2014-2015 and the period of work order has admittedly come to an end. Needless to mention that if the appellants feel aggrieved with any of the conditions of new tender that may be invited for subsequent years, they will be at liberty to challenge the same by filing writ petition. With the above observation, the appeal is dismissed.
