JUDGMENT & ORDER : Heard Ms. R. Purakayastha, learned counsel appearing for the petitioner as well as Mr. T.D. Majumder, learned Government Advocate appearing for the respondents. 2. Since on the basis of the complaint dated 22.04.2016 made by the petitioner, Melaghar Police Station did not register any case despite disclosure of cognizable offence, the petitioner being aggrieved, has filed this writ petition urging the following reliefs before this court: “To register the FIR against the accused persons as per the written complaint dated 22.04.2016 submitted by the petitioner being the victim of the cognizable offence committed by the accused persons jupon the petitioner and also to investigate the matter and further to direct them to do the necessary actions as per the Act and the procedure and also to act in strict compliance of the provisions of law in terms of the judgments passed by the Hon’ble Apex Court and this Hon’ble Court.” 3. Now, Ms. Purakayastha, learned counsel appearing for the petitioner has fairly submitted that during pendency of the writ petition, a specific case has been registered on the basis of the complaint dated 22.04.2016. She has made this statement on the instruction of the petitioner. As such, this writ petition has become infructuous. 4. Since, the petitioner at the beginning has expressed apprehension about the investigating agency, it is directed that the Superintendent of Police, Sepahijala, shall monitor the investigation, which according to this court is the part of his duty also, so that the end of justice is achieved. It is further expected that the investigation will be done with required expedition. 5. Accordingly, this writ petition is disposed of. A copy of this order be furnished to Mr. T.D. Majumder, learned Govt. Advocate for onward transmission.
