JUDGMENT : Daya Chaudhary, J. C.M. No. 11511 of 2016 This is an application for placing on record resolution dated 25.03.2016 (Annexure P-6). Application is allowed and Annexure P-6 is taken on record. CWP No. 18118 of 2016 2. The grievance of the petitioner in the present petition is that a submersible pump was installed by the Panchayat in the Phirni which is in front of house of respondent No.6 but petitioners are not allowed to take water from it. Thereafter, petitioners approached to respondent No.5, who is Sarpanch of the village but he has not taken any action by stating that this Pump has been installed by respondent No.6. Petitioners sought information under the Right to Information Act, according to which, the submersible pump has been got installed by the Panchayat for the public at large but still that is being personally used by respondent No.6. 3. Petitioners have made representations to Additional Deputy Commissioner/Deputy Commissioner, Panipat, which are annexed as Annexures P-2 and P-3, but no action has been taken so far. Petitioners have also placed on record the photographs in this regard. 4. Without going into the controversy and without commenting anything on the merits of the case and by considering submissions made by learned counsel for the petitioners that representations have been given to Deputy Commissioner as well as Additional Deputy Commissioner, Panipat but no action has been taken so far, this petition is disposed of with a direction to respondent No.2-Deputy Commissioner, Panipat to look into the representations filed by the petitioners and take necessary action in accordance with law within a period of four weeks from the date of receipt of copy of the order. In case the petitioners and respondent No.6 are required to be heard for decision of the representations, they may be given opportunity. 5. Writ petition stands disposed of accordingly.
