JUDGMENT Hon’ble Sudhanshu Dhulia, J. (Oral) Heard Mr. Kurban Ali, Advocate for the applicant and Mr. K.S. Rautela, learned Government Advocate assisted by Ms. Shivali Joshi, Brief Holder present for the State/respondent No.1. 2. A First Information Report has been lodged by respondent No.2 against the present applicant which has been registered as Case Crime No.78 of 2015, at Thana Kotdwar, District Pauri Garhwal alleging that her minor daughter committed suicide which was abetted by the present applicant. After investigation, police submitted charge sheet under Sections 305/363 of IPC, thereafter, learned Magistrate took cognizance in the matter and issued summon to the present applicant. Hence, this application under Section 482 Cr.P.C. has been filed by the applicant before this Court praying that charge sheet be quashed and also prays that Criminal proceedings pending before learned Additional Chief Judicial Magistrate, Kotdwar in Criminal Case No.930 of 2015 be stayed. 3. The applicant would be at liberty to move an application for his bail, the same shall be considered on the same day itself on its merit. While doing so the court below shall consider the fact that present applicant is only 20 years of age. He shall also examine whether there was any active abetment on the part of the applicant in the alleged suicide. 4. In case, the bail application is rejected, then the learned Magistrate shall forward the papers on the same day before the concerned Sessions court which shall consider the bail on the same day itself, on the same terms as directed to the learned Magistrate. 5. With the aforesaid observation, the Criminal Misc. application under Section 482 Cr.P.C. stands disposed. 7. Urgency application stands disposed accordingly.
