JUDGMENT Hon’ble Sudhanshu Dhulia, J. (Oral) Heard Mr. Karan Anand, learned counsel for the applicant, Mr. P.S. Saun, Deputy Advocate General with Ms. Sangeeta Bhardwaj, learned Brief Holder for the State and perused the records. 2. The applicant is in jail being implicated in Case Crime No. 292 of 2015, under Section 376 of I.P.C. at Police Station Dalanwala, District Dehradun. 3. Learned counsel for the applicant submits that the mother of the prosecutrix/girl has sold her daughter to the applicant and took ‘70,000/- (Rupees Seventy Thousand only) from the applicant. Subsequently, the applicant married with the victim/prosecutrix. According to the applicant, the mother of the victim/prosecutrix did not inform about the fact that her daughter (Ankita) has already married in Uttarakashi. The applicant is in jail since 29.12.2015. 4. Considering the facts and circumstances of the case as well as other material available on record, the applicant has been able to make out a case of bail. Accordingly, the bail application is allowed. 5. Let the applicant (Shiv Nath) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties of the equal amount to the satisfaction of the court concerned. 6. It is made clear that any observations made by this Court are only for the purposes of disposal of bail application. 7. It shall not be taken into consideration at all in any other proceedings.
