JUDGMENT Hon’ble Sudhanshu Dhulia, J. Counter affidavit filed by the State in the Court is taken on record. 2. Heard Mr. J.S. Virk, learned counsel for the applicant, Mr. P.S. Saun, Deputy Advocate General with Mr. Vishal Singh, learned Brief Holder for the State and perused the records. 3. The applicant is in jail being implicated in F.I.R. No. 124 of 2016, which has been registered under Sections 3/7 of Essential Commodities Act at P.S. Haldwani, District Nainital. 4. The First Information Report has been lodged by one Vijay Chandra Joshi, who is Regional Food Officer, Haldwani, District Nainital. The present applicant is the driver of a tampo of M/s Kathgodam Gas Services. The allegation against the applicant is that he was carrying domestic gas cylinders, which were found below the actual quantity of gas. The applicant is in jail since 05.05.2016. 5. Considering the overall facts and circumstances of the case as well as other evidence available on record, the applicant has been able to make out a case for bail. The bail application is accordingly allowed. 6. Let the applicant (Trilok Singh Bisht) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties of the equal amount to the satisfaction of the court concerned. 7. It is made clear that any observations made by this Court are only for the purposes of disposal of the bail application. It shall not be taken into consideration at all in any other proceedings.
