JUDGMENT Rajan Roy,J. The subject matter of the public interest litigation is the grievance of the petitioners that the second respondent ? Chhatrapati Shahu Ji Maharaj University ? is not providing original mark-sheets for students of the first and second year of graduation courses (B.A./B.Sc./B.Com). 2. The learned counsel appearing on behalf of the University states that it is not in dispute that the mark-sheets are available to all students on-line. It is open to the students to down load them. 3. The learned counsel appearing on behalf of the petitioners submits that the necessity of the mark-sheets of the first and second year arises because when students appear for counselling for various courses, they are required to furnish mark-sheets of the first year, second year and of the final year of graduation separately. 4. The learned counsel appearing on behalf of the University states that the University does provide the mark-sheets of the first and second year since, after the results of the final year are declared, the mark-sheet includes the marks which have been obtained by the students for the first year and the second year. This formality has been adopted for the current session. 5. The learned counsel appearing on behalf of the petitioners prays that the petitioners may be permitted to withdraw the writ petition with liberty to move the Chancellor. 6. We, accordingly, dismiss the petition as withdrawn since the petitioners intend to move the Chancellor for appropriate directions in regard to the grievance under the provisions of the U.P. State Universities Act, 1973. There shall be no order as to costs.
