JUDGMENT Hon’ble Sudhanshu Dhulia, J. (Oral) Correction Application (CRMA No. 961 of 2016) has been filed on behalf of the applicant to the effect that he may be permitted to incorporate the correct particulars of the applicant in the memo of parties by incorporating the words “Waseem Ahmad @ Ramjane @ Shanu S/o Shri Shamim Ahmad, R/o Village Sadruddin Nagar, P.S. Nahtor, District Bijnor (U.P.) in place of “Waseem Ahmad R/o Puchaddi, Police Station Ramnagar, District Nainital”. 2. For the reasons stated in the correction application, the same is allowed. Let the necessary correction be incorporated by the applicant during the course of the day. 3. Counter affidavit filed in Court today on behalf of the State is taken on record. 4. This is first bail application seeking regular bail in FIR No. 60 of 2016 under Sections 454, 380 & 411 IPC, registered at Police Station Ramnagar, District Nainital. 5. Heard Mr. Pankaj Goswami, Advocate for the applicant and Mr. Hari Om Bhakuni, AGA assisted by Mr. Rakesh Kunwar, Brief Holder for the State. 6. Mr. Pankaj Goswami, learned counsel appearing for the applicant submits that co-accused, namely, Aftab and Salman Siddiqui have already been released on bail by this Court vide orders dated 22.06.2016 and 28.06.2016 respectively. The applicant is in jail since 18.03.2016. 7. Considering the overall facts and circumstances of the case, prima facie, the applicant has been able to make out a case for bail at least on parity. The bail application is allowed accordingly. 8. Let the applicant be enlarged on bail in connection with the FIR in question on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the court concerned. 9. It is made clear that any observation made by this Court is only for the purpose of disposal of this bail application. It shall not be taken into consideration at all in any other proceedings.
