JUDGMENT Mr. Ajay Tewari, J. (Oral):- This is a petition for grant of anticipatory bail to the petitioner under Section 438 Cr.P.C. in case FIR No.80 dated 14.09.2016 registered under Section 394 IPC at P.S. Kiratpur Sahib, District Rupnagar. 2. The complainant used to go on every Tuesday to collect money from Hoshiarpur to Kiratpur Sahib. On fateful day when the complainant collected money two people attacked him and caused injuries and took the bag of money. As per the allegations in the FIR the complainant stated that he would be able to recognize the assailants. 3. Learned counsel for the petitioner has argued that petitioner was not involved in this case and was falsely implicated. 4. In my opinion, in the interest of justice it would appropriate if the petitioner would appear before IO on 27.10.2016. and IO shall arrange Test identification parade. In case the petitioner is not recognized by the complainant, then the petitioner be released released on anticipatory bail to the satisfaction of the Investigating Officer subject to the conditions envisaged under Section 438(2) Cr.P.C. In case the petitioner is duly identified by the complainant he would obviously be taken into custody. 5. Learned counsel for the petitioner states that he would have no objection to the Test Identification Parade but he be permitted to be accompanied by an advocate to ensure that Test Identification Parade is conducted fairly. Allowed. 6. Petition stands disposed of.
