ORDER : This Contempt Petition is filed complaining that the order passed by this Court in W.P(MD)No.1115 of 2015, dated 30.01.2015, is not complied with. 2. On 27.11.2015, when the matter was taken up for hearing, this Court issued statutory notice to the respondent returnable by four weeks. Today, the respondent is personally present before this Court. 3. The learned Government Advocate appearing for the respondent/contemnor submitted that by proceedings dated 20.03.2015 and 31.03.2015, the order passed by this Court has been complied with and retirement/terminal benefit of the petitioner has been disbursed. 4. On the other hand, the learned counsel appearing for the petitioner submitted that the respondent has made some deduction, while disbursing the terminal benefits, which is not legally sustainable. Needless to say that it is open to the petitioner to challenge the said deduction in a manner known to law in a separate proceedings. However, insofar as the contempt petition is concerned, as it is seen that the respondent has complied with the order by issuing the proceedings dated 20.03.2015 and 31.03.2015 as stated supra, I find nothing survives in this contempt petition to be adjudicated upon further. 5. Accordingly, this contempt petition is closed with a liberty to the petitioner to workout his remedy, in respect of the amount deducted, in a separate proceedings. Consequently, the appearance of the respondent is dispensed with and Sub A(MD)No.241 of 2015 is closed. No costs.
