JUDGMENT Hon’ble Sudhanshu Dhulia, J. (Oral) 1. Mr. Mohit Maulekhi, Advocate for the applicants. 2. Mr. K.S. Rautela, learned Government Advocate assisted by Mr. H.S. Rawal, learned A.G.A., for the State of Uttarakhand/respondent no. 1. 3. The present applicants before this Court are husband, father-in-law and mother-in-law of respondent no. 2 who has lodged the first information report against all the applicants under Sections 498A/323/504/506 of IPC and under Section 3/4 of the Dowry Prohibition Act at Police Station Lal Kuwan, District Nainital. After investigation, charge-sheet has been filed by the police in the matter. Consequently, the learned Magistrate took cognizance and issued summons to the present applicants. Hence, the present application has been filed by the present applicants under Section 482 CrPC invoking the extraordinary jurisdiction of this Court. 4. According to the applicants, the marriage of applicant no. 1 and respondent no. 2 was solemnized in Chandigarh and the entire cause of action as alleged by the respondent no. 2 occurred in Chandigarh, therefore, there is no jurisdiction in the courts in Uttarakhand in the matter. 5. Since the charge-sheet has been filed by the police in the matter. At this stage, no interference is being called for by this Court in the matter. However, the applicants would be at liberty to raise the jurisdictional as well as legal facts before the court below which shall be duly considered in accordance with law, particularly the point of jurisdiction, before passing any order. 6. It is further directed that since the applicants are permanent resident of Chandigarh, in case need arises, they shall be allowed to furnish one surety only and if local surety is not available then they shall be allowed to furnish surety from outside Uttarakhand as well. As this may take time in the intervening period the courts below shall also consider granting interim bail to them, in the interest of justice. 7. In view of the above, the application under Section 482 CrPC stands disposed accordingly. 8. Urgency application (IA No.234 of 2016) also stands disposed accordingly.
