JUDGMENT Heard learned counsel for the applicant and learned AGA for the State. This application under Section 4 82 Cr.P.C. is filed against the summoning order dated 29.7.2015 in complaint case no. 557 of 2014 ( Somwati Vs. Nem Singh and others) under Section 4 98-A, 323 and 504 IPC and Section 3 /4 Dowry Prohibition Act, P.S.- Sirauli, District- Bareilly. From the perusal of record, I do not find any cogent ground for interference under Section 4 82 Cr.P.C. Looking to the nature of dispute being matrimonial, the court below shall refer the matter to the Mediation Centre at the first instance and in case proceedings are successful, appropriate orders be passed having regard to the judgements passed by the Apex Court. Once the proceedings are referred to the Mediation Cell in terms of the order passed by the court below, the criminal proceedings shall remain stayed subject to the outcome of mediation proceedings. The applicant is directed to deposit Rs. 3000/- to District Legal Services Authority, Bareilly within three weeks from today, out of which, Rs. 1500/- shall be paid to the opposite party no. 2 for appearance before the Mediation Centre and Rs. 1500/- shall go to the District Legal Services Authority, Bareilly. Mediation proceedings will be decided within six months. After depositing the aforesaid amount, notice shall be issued to the parties and in case, the aforesaid amount is not deposited within the aforesaid period, the interim protection granted above shall automatically stand vacated. In the event mediation fails, it shall be open to the applicant to appear before the court below and apply for bail which shall be considered keeping in view of the law laid down by the Full Bench of this Court in the case of Amarawati and another Vs. State of U.P., reported in 2004(57) ALR 390 and by the Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P., reported in 2009(4) SCC 437 . With the above observation and direction, this application is finally disposed of.
