JUDGMENT : JASPAL SINGH, J. 1. By virtue of instant petition preferred under Section 438 Cr.P.C., petitioner-Bittu has sought pre-arrest bail feeling apprehension of his arrest in case FIR No. 6, dated 17.01.2016, under Sections 406 and 420 of IPC, registered at Police Station Adampur, District Jalandhar. 2. At the time of issuance of notice of motion on September 01, 2016, following order was passed: “Inter alia, it has been contended by learned counsel for the petitioner that Raghubir Chand son of Rana Partap, resident of H.No.3220/10, Mohalla Dashmesh Nagar, Adampur gave a sum of Rs. 1,40,000/- to Davinder @ Laddi in the presence of the petitioner, while sitting in his office. Moreover, all the allegations are against Davinder @ Laddi, who has already been granted the concession of pre-arrest bail by ld. Additional Sessions Judge, Jalandhar. Notice of motion to the respondent for 07.11.2016. In the meanwhile, petitioner is directed to join the investigation. In the event of arrest, petitioner shall be released on pre-arrest bail at the satisfaction of the Arresting Officer/Investigating Officer subject to the conditions, as envisaged under section 438(2) Cr.P.C.” 3. On instructions from ASI Nirmal Singh, Learned State counsel has submitted that in compliance of order dated September 01, 2016, petitioner has already joined the investigation on 21.09.2016 before the trial Court and is no more required for further interrogation. 4. Accordingly, order dated September 01, 2016 is made absolute and shall enure during the pendency of trial. 5. However, petitioner shall be abide by all the terms and conditions as envisaged under Section 438(2) Cr.P.C. Disposed of.
