JUDGMENT K.M. Joseph, C.J. (Oral) The prayer in the writ petition is as follows: “to issue a writ, order or direction in the nature of mandamus directing and commanding the respondent nos. 1 & 2 to provide adequate safety and security to the petitioner as the petitioner is seriously apprehending the fear of his life and liberty at the hands of respondent nos. 3 & 4.” 2. Briefly put, the case of the petitioner is as follows: Petitioner and his family are joint owners of certain properties. A suit was filed against certain persons. The two of the defendants executed sale deeds. Thereafter, there is reference to two FIRs being lodged against the petitioner. Allegation is made against the local MLA (the 4th respondent). 3. The suit is pending and there are also FIRs against the petitioner. The complaint of the petitioner, as reflected in the relief sought, is that there is threat to his life. 4. Today when the matter was taken up, Sri Nagesh Agarwal, Advocate appeared on behalf of respondent nos. 3 & 4. We also heard Sri D.K. Sharma, Additional Advocate General on behalf of the State. 5. Learned Additional Advocate General would submit that there are two criminal cases against the petitioner. More importantly, learned counsel for respondent nos. 3 & 4 would submit that there has been no threat and there will be no threat to the life of the petitioner from their side. We only record this submission and dispose of the writ petition. 6. We make it clear that any Court, before which any lis relating to the property is pending, will decide the matter untrammeled by anything contained in this judgment. Equally, this judgment will not stand in the way of the investigation of the cases against the petitioner, as per law.
