ORDER : None for the appellants. 2. We have heard learned counsel for respondent nos. 1 and 2, and perused the record. 3. The appellants - Ranjit Kaur and Amarjeet Singh in Criminal Miscellaneous Writ Petition No. 9444 of 2012 gave out, that they had voluntarily married one and another of their own sweet will. It was also the assertion of Ranjit Kaur, that she was not living with Amarjeet Singh on account of any compulsion or coercion, nor had she been kidnapped by Amarjeet Singh. 4. In the absence of material proof of the age of Ranjit Kaur, the High Court in the impugned order dated 19.07.2012 recorded as under: "Since, there is no dependable proof of age of petitioner-wife as no reliable school certificate is available, we direct her to appear before the Chief Judicial Magistrate/Magistrate, Bijnor within two weeks from today who shall direct the Investigation Officer to produce her before the C.M.O. concerned for the purpose of getting her medical examination done for ascertaining her age as per her appearance and also by a radiological examination." Consequent upon the aforesaid direction, the medical report issued by the Chief Medical Officer, Khiri has been placed on the record of the case. The same is extracted hereunder: "OFFICE OF THE CHIEF MIDICAL OFFICER, KHIRI Letter No. C.M.O./Age-Proof/2012 Date: 8.06.2012 AGE CERTIFICATE It is certified that Smt. Ranjit Kaur D/o Late Anoop Singh R/o village Eithpur Post Palia, P.S. Palia, District Lakhimpur Khiri is present in person with affidavit dated 05.06.2012 related to the Department of Registration of marriage today before me for her age certification I have taken medical examination to her and X-ray examination conducted on 06.06.2012 and x-ray plate no. is 1571. On the basis of report of physical anotomi clinical examination and senior radiologist report, in my view the age of Ranjit Kaur is about 20 years (Twenty years). It identification mark: Black mole on left side of face just near ala of nose left side. 1. Height - 164.7 cm 2. Weight - 47kg 3. Teeth - 16/16 Mark : Thumb Sig/certified Sd/-/Illegible Sd/- (illegible) Stamp Chief Medical Officer Lakhimpur Khiri (Pass port size photo) Sd/- Illegible Stamp CMO/Lakhimpur Khiri" 5. Based on the aforesaid report, it is apparent, that Ranjit Kaur can be taken to be 20/21 years old, on the date of the said report. 6. Weight - 47kg 3. Teeth - 16/16 Mark : Thumb Sig/certified Sd/-/Illegible Sd/- (illegible) Stamp Chief Medical Officer Lakhimpur Khiri (Pass port size photo) Sd/- Illegible Stamp CMO/Lakhimpur Khiri" 5. Based on the aforesaid report, it is apparent, that Ranjit Kaur can be taken to be 20/21 years old, on the date of the said report. 6. In view of the fact, that the first information report was registered by the mother of Ranjit Kaur on 10.05.2012, there can be no serious doubt about the fact, that Ranjit Kaur was a major on the date when she accompanied Amarjeet Singh. 7. In the above view of the matter, since she has clearly affirmed that she accompanied Amarjeet Singh by her own will, and without any compulsion and coercion, nothing survives in the matter. Accordingly, FIR No. 150 dated 10.05.2012 registered by the mother of Ranjit Kaur on 10.05.2012 at Police Station Barhanpura, Sub-District Nagina, District Bijnour under sections 363/366 of the Indian Penal Code, against the appellants is hereby quashed. The instant appeal is accordingly allowed.
