ORDER C.M. No.32222/2016 (clarification) 1. This is an application seeking clarification of an order passed by this Court on 12.08.2016. By way of this application, it is contended that in view of the order passed by a Division Bench of this in a connected matter in LPA No.69/2015, Raj Singh Vs. NDMC , the Court had been pleased to hold that the hawkers be not dispossessed from their existing sites; submission being that in the present case also, a clarification is required to the effect that the aforenoted vendors who have been granted protection by this Court on 12.08.2016 be not dispossessed. This Court notes this submission. This Court also notes the order which has been passed by this Court on 12.08.2016. This submission now propounded before this Court that they should not be dispossessed and a status quo order be passed was also addressed on that date and this is clear from the averments made in the writ petition. 2. This application seeking clarification in view of this Court is not maintainable as this is not modification which is sought but a rehearing and re-appraisal of the arguments on the same issue which this Court had already heard on 12.08.2016. 3. Application is dismissed.
