SOHAN VEER SINGH v. KUNWAR SINGH

2016-07-15

SERVESH KUMAR GUPTA

body2016
JUDGMENT Hon’ble Servesh Kumar Gupta, J. Since both these revisions are interconnected as pertained to the same rented property, owned by Kunwar Singh and under the tenancy of Sohan Veer Singh (Sohanvir Singh), hence are being taken up together for the adjudication. 2. After hearing the rival contentions on merit, learned Counsel of the tenant submitted that if some reasonable time is granted to the tenant for vacating the premises, then both these revisions may be disposed of in such terms. 3. As this Court has been apprised that Kunwar Singh has come in the civil life after his superannuation and since he was wont of regimental discipline, hence every time there remains tense atmosphere between the parties. Albeit Kunwar Singh has taken the re-employment at some other place, but his family is residing in the same part of the premises. Hence, the possibility of regular quarrel is difficult to be ruled out. 4. On the other hand, learned Counsel on behalf of the tenant has apprised that Mr. Sohan Veer Singh is almost an unemployed youth and preparing for some examination to find the job. 5. Therefore, on assessing the whole situation, I grant three months’ time, as agreed by both the parties, to vacate the premises. However, at the same time, I do not find it proper to enhance the rent or mesne profit. 6. The tenant will vacate the building latest by 31st October 2016 and will make the payment of rent and mesne profit @ Rs. 1500/- per month. He will make up-to-date payment of electricity and water charges to the concerned authorities, otherwise the same shall be recoverable from him only by the department. Tenant will also take care to transfer the possession of the premises in a very neat and clean manner and in the same state in which it existed at the time of his entering into such possession. 7. With the directions as above, both these revisions stand disposed of finally. Let the lower court record be sent back.
