JUDGMENT K.M. JOSEPH, C.J. (Oral) Petitioner has approached this Court in purported public interest against the proposed grant of a Bar licence to the 12th respondent. 2. In brief, the case of the petitioner is as follows: At Bhimtal, where the Bar licence is proposed to be given, there is, within 100 meters, Birla Institute of Applied Sciences, which is an educational institution, and the law forbids grant of a Bar licence within 100 meters of an educational institution. An NOC has been granted, which is in violation of the law. Furthermore, he has a case that before a Bar licence is granted, there must be restaurant for a period of one year. Without any such condition being fulfilled, NOC has been granted. 3. We heard learned counsel for the petitioner and the learned Deputy Advocate General on behalf of the official respondents. 4. We would not think that at this juncture, we should interfere. We would expect respondent no. 3, who is the Authority to grant the licence, to act as per law. At this stage, we do not wish to say anything more. Should there be actual grant of licence in violation of law and if the petitioner is advised to approach this Court, we leave it open to the petitioner to do so and also to challenge the NOC, which is allegedly illegally granted. 5. The writ petition stands disposed of.
