JUDGMENT : Jaspal Singh, J. 1. This is a petition under Section 439 Cr.P.C. preferred by the petitioner for grant of bail in case FIR No. 44 dated May 18, 2016 under Sections 201, 406, 420, 465, 467, 468, 471, 120-B IPC read with Sections 4 & 5 of Prize Chits & Money Circulation Scheme (Banning Act), 1978, registered at Police Station, Gidderbaha, District Sri Muktsar Sahib. 2. Concededly, the petitioner was arrested in this case on July 15, 2016 and after subjecting to custodial interrogation, he was remanded to judicial custody, meaning thereby, he was not required for further custodial interrogation. Otherwise also, allegations against the petitioner are that while working as an agent of chit fund company (M/s Matribhumi Manufacturing & Marketing Limited Company, Ranchi, Jharkhand), he is alleged to have allured various persons and collected Rs. 10 lac for the company, which is allegedly misappropriated. But, at one stage, complainant was also one of the agency, however, subsequently, he became member of the company, and he succeeded in falsely implicating the petitioner by way of registration of the instant case. 3. It is an undisputed fact that during the incarceration of the petitioner in this case, his wife has been taken away by nature on December 08, 2016 and after her demise, his four children are being taken care of by their maternal uncle. Otherwise also, investigation is complete and challan has already been presented, which is not likely to be disposed of within a short span of time. 4. Taking into consideration aforesaid aspects but without commenting on the merits of the case, this Court is of the considered that it would not be justifiable to keep the petitioner behind the bars for an indefinite period. Accordingly, the petition is allowed. 5. Petitioner is ordered to be released on bail to the satisfaction of Trial Court/Duty Magistrate.
