JUDGMENT Yashwant Varma, J. The Colvin Hospital at Allahabad is a Divisional Hospital which is stated to cater to the requirements of patients from a large number of proximate districts. However, the hospital does not have, it is alleged, a Trauma Centre, Intensive Cardiac Care Unit, Intensive Care Unit, CT Scan or even an MRI or Dialysis facility. Moreover, it has been stated that there is an acute shortage of doctors, paramedical staff and support staff in the emergency and blood bank sections of the hospital. In consequence, it has been stated that even the blood reports are made available only after a considerable delay, leading patients to carry out tests at private laboratories at their own expense. 2. The petitioner has relied upon an audit report for the period between January 2011 and January 2014. The learned Standing Counsel has placed on the record the instructions which have been received by him from the Chief Superintendent of the Motilal Nehru Divisional Hospital. The instructions which have been placed on the record also indicate the nature of the work which is being performed at the hospital and the facilities which are available. 3. In our view, having due regard to the fact that the hospital in question is a major divisional hospital, it would be appropriate if the Director General, Health and Family Welfare, U.P. is directed to look into all matters pertaining to the functioning of the hospital, the presence of required facilities and the availability of sanctioned staff where the facilities can be duly manned. 4. For this purpose, the Director General shall, preferably within a period of one month from the receipt of a certified copy of this order, cause a proper inspection conducted of the hospital by an inspection team constituted under his authority. The inspection team, it is needless to add, should consist of doctors and other persons who are duly experienced with the running of a public hospital of this nature. The inspection team shall submit its report to the Director General, no later than a period of one month from the date of the constitution of the team.

Thereafter, the Director General shall take such necessary steps as are required, in order to ensure that in particular equipments, medicines and staff is made available for the proper functioning of the hospital and that deficiencies, as may arise on the basis of the report, are duly rectified. 5. We would expect that this exercise should be completed within a period of three months from the receipt of a certified copy of this order. We leave it open to the Director General to take any such steps which may be required for the purposes of betterment of the hospital. 6. The petition is accordingly disposed of. There shall be no order as to costs.
