JUDGMENT : Hon'ble Pankaj Mithal, J. The Civil Judge (Senior Division) by the order dated 19.08.2016 has granted succession certificate in favour of the respondents No.1, 2 & 3. The above order has been challenged by means of this petition under Article 227 of the Constitution of India. Against the aforesaid order the petitioner has a remedy of filing an appeal before the District Judge. It is pertinent to clarify that ordinarily application for grant of succession certificate lie before the District Judge under Section 372 of the Indian Succession Act, 1925 (In short Act). However, the State Government by notification in the official gazette may confer this power even upon to any other Judicial Officer inferior to the grade of District Judge. The State Government vide notification dated 11.03.1955 has invested the aforesaid power upon Civil Judges as well as all Munsifs (Now Civil Judge, J.D.) in the State. Section 388(2) of the Act provides that where a matter in this regard is decided by an Officer inferior to the District Judge, the appeal provided under Section 384 of the Act to the High Court would lie to the District Judge. In view of above, since the order impugned is an order passed by an Officer inferior to that of the District Judge, the petitioner has a remedy of filing an appeal under Section 384 read with Section 388(2) of the Act before the District Judge. Accordingly, the petition is dismissed on the ground of alternate remedy.
