ORDER 1. With consent the matter is heard. 2. Petitioners are aggrieved of non-grant of compensation in the matter of alleged loss of crops on their land due to submergence. 3. Petitioner owner of agriculture land bearing Khasra No.113/1 (area 0.569 Ha) and Khasra No.113/2 (area 0.244 Ha) situated at village Nandia, Tahsil Gotegaon, being unsuccessful in getting the compensation for the loss and damaged crop due to seepage from Naadiya Reservior, approached the High Court vide Public Interest Litigation Writ Petition No.2981/2014 (PIL) which was disposed of on 26.3.2014 in the following terms : “Considering the nature of grievance made in this petition and the fact that the petitioners through Counsel submit that they would be content if the payment of compensation to the petitioners is expedited, we dispose of this petition with direction to respondent No.3-Collector to examine the claim of compensation of these petitioners expeditiously and final decision be taken thereon, one way or the other, at the earliest not later than 30.6.2014 after following due process and the same be communicated to the parties before the said date. Compliance report in this behalf be filled by the Collector in this Court before 23.6.2014, filling which the matter be notified on 1.7.2014 under caption "Directions" for issuing further directions or initiating appropriate action, as may be advised. Subject to above, petition is disposed of.” 4. That on the compliance being reported by the State functionaries following order was passed : “Counsel for the State submits that the report has been submitted by the Collector on 25.7.2014 and not before 23.6.2014 as a result of which the matter is notified today. In view of the said report nothing more is required to be done in this petition as it is already disposed in terms of order dated 26.3.2014. Papers be consigned to the record. We make it clear that the petitioner and similarly placed persons are free to pursue remedy as may be permissible in law. The unconditional apology tendered on behalf of the Collector in failure to submit the report before the specified date, in terms of order dated 26.3.2014, is accepted.” 5. Though it is contended on behalf of the petitioner that the Collector has misinterpreted the relevant clauses of section 30 of M.P. Irrigation Act, 1931 which can be corrected only by invoking jurisdiction under Article 226 of the Constitution of India; however, this Court finds force in the submissions on behalf of the State counsel that the petitioner has statutory, efficacious remedy under sub-section (3) of section 30 of 1931 Act. 7. Sub-section (3) of section 30 of 1931 Act provides that : “(3) Any person aggrieved by the decision of the Collector under sub section (2) may, within six months from the date of such decision, institute a civil suit in a civil Court to have such decision set aside or modified.” 8. In view whereof, since the civil Court has been empowered not only to set aside decision by Collector but also modify the same, it will within the jurisdiction of the civil Court to analyze even the facts in the context to the statutory provisions, the apprehension expressed by the petitioner is without any foundation. 9. Consequently, the petition is finally disposed of with liberty to the petitioner to avail the statutory remedy. No costs.
