ORDER : I.A. 203/2016 (by the plaintiff u/S 151 CPC for withdrawal of the suit) 1. The present application has been filed by the plaintiff stating inter alia that during the pendency of the present suit, the parties have arrived at an out of court amicable settlement in terms of the Agreement dated 31.12.2015 (Annexure A-1), whereunder the defendant has agreed to pay a sum of Rs.15,14,591/- to the plaintiff in full and final settlement of all its claims, subject matter of the present suit. 2. Counsel for the defendant states that he has brought a demand draft bearing No.022579 dated 30.12.2015 drawn on HDFC Bank, I.P. Extension, Patparganj Branch, in favour of the plaintiff/company for a sum of Rs.15,14,591/-, which is duly accepted by the counsel for the plaintiff, who states that having received the agreed amount, he does not wish to press the present suit any further. 3. For the reasons stated in the application, the same is allowed. The suit is disposed of alongwith the pending application. No orders as to cost. 4. File be consigned to the record room.
