ORDER : We have heard learned counsel for the parties yesterday and today. 2. After hearing detailed arguments and going through the records, we are of the opinion that the matter is eminently worth settling. 3. We are glad that both learned counsel for the parties have agreed to settle the matter. Learned counsel for the respondent has agreed to the settlement on instructions from Mrs. Ishita Jitendra Dagaonkar, w/o Shri Jitendra Dagaonkar (respondent No.2), who is present in Court. 4. On a consideration of the material on record, we are of the view that a one time lumpsum payment of L 1.25 crores should be made by the appellants to respondent No.2 in full and final settlement of the disputes between the parties. The amount be paid through a demand draft in favour of respondent No.2 within a period of four weeks from today. 5. We make it clear that since there is no other member of the housing society before us, the benefit of today's order is only on the peculiar facts of this case and is limited only to the advantage of respondent No.2 and will not enure to the benefit of any other member of the society. 6. In view of the settlement, the complaint filed by respondent No.2 will stand quashed. The criminal appeal is disposed of.
