ORDER : HARSHA DEVANI, J. By this application, the applicant, who is the wife of the respondent No. 3-convict seeks cancellation of temporary bail granted to the respondent No. 3-convict vide order dated 03.02.2016 made in Criminal Misc. Application No. 1995 of 2016, as extended vide order dated 17.02.2016 made in Criminal Misc. Application No. 3813 of 2016 for a further period of ten days as he was required to undergo further treatment. 2. Heard Mr. Kshtij M. Amin, learned Advocate for the applicant, Ms. Maithili Mehta, learned Additional Public Prosecutor for the respondent No. 1, Mr. A.Y Kogje, learned Special Public Prosecutor for the respondent No. 2 and the respondent No. 3, who is personally present before this Court. 3. From the averments made in the memorandum of application, as well as, as stated before this Court, upon his release from jail and being discharged from the hospital, the respondent No. 3 has beaten the applicant and her son mercilessly. Under the circumstances, it appears that the respondent No. 3 has recovered and therefore, can be appropriately taken care of by the jail authorities. 4. The temporary bail granted to the respondent No. 3 vide order dated 03.02.2016 made in Criminal Misc. Application No. 1995 of 2016, as extended vide order dated 17.02.2016 made in Criminal Misc. Application No. 3813 of 2016 therefore, requires to be curtailed from today. 5. In view of the above, the application succeeds and is, accordingly, allowed. The temporary bail granted to the respondent No. 3 vide order dated 03.02.2016 as extended vide order dated 17.02.2016 is hereby curtailed till today. Accordingly, the respondent No. 3 is directed to forthwith report back to the jail authorities. The jail authorities are further directed to provide necessary medial treatment to the respondent No. 3. Rule is made absolute accordingly. 6. It is clarified that as and when respondent No. 3-convict moves any application for temporary bail, the Registry shall bring this order to the notice of the Court.
