JUDGMENT An earlier public interest litigation instituted by the petitioner on the subject matter of these proceedings was dismissed by this Court on 23 May 2012. Against the order of this Court, a Special Leave Petition was filed before the Supreme Court. An order was passed on 3 September 2012 in the following terms: "We find no reason to entertain this public interest litigation. All the same, if the petitioner has any grievance, he may approach the Government and it is for the State Government to consider the matter in accordance with law. Special Leave Petition stands disposed of." 2. These disclosures have been made in paragraphs 8 and 9 of the writ petition. Thereafter, as the record would indicate, the Principal Secretary, Higher Education Department passed an order on 15 March 2013. The order notes that a writ petition namely Writ Petition No 40642 of 2009 is pending before this Court and the State Government shall abide by such orders as are passed therein. According to the learned counsel, the aforesaid writ petition has been withdrawn. 3. Be that as it may, we are not inclined to entertain a second public interest litigation on the same subject having due regard to the fact that an earlier petition was not entertained by this Court and the Supreme Court while confirming the order of this Court observed that there is no reason to entertain the public interest litigation but if the petitioner has any grievance, he may approach the State Government and that it is for the State Government to consider the matter in accordance with law. 4. We, therefore, decline to entertain the writ petition. The petition is accordingly dismissed. There shall be no order as to costs.
