ORDER : 1. Ms. Dheera Khandelwal, Additional Chief Secretary, Women & Child Development Department, Government of Haryana is present in Court. 2. Ms. Khandelwal says that the vacancies in the Child Welfare Committee in Gurgaon could not be filled up as there are no Rules under the Juvenile Justice (Care and Protection of Children) Act, 2015 (for short 'the Act'). In the absence of any Rules having been framed, it is not possible to fill up the vacancies. 3. Learned Additional Solicitor General disputes this and refers to Section 110 of the Act. He submits that the primary responsibility for framing Rules under the Act is with the State Government and not the Central Government. 4. An affidavit has been shown to us (which may now be filed in the Registry) in which it is stated that under an administrative order Smt. Archna, Sh. Ali Hasan and Sh. Rakesh Kumar Bhargava have been deputed to attend the proceedings of the Child Welfare Committee, Gurgaon as members of the Committee twice in a week on roster basis till further orders. 5. On the request of learned counsel for the State of Haryana, list the matter on 28th March, 2016 by which date steps should be taken to ensure the full complement of members in all the Child Welfare Committees of Haryana. 6. The presence of Ms. Khandelwal is dispensed with.
