JUDGMENT The reliefs which have been sought in the public interest litigation are in the following terms: "(a) Issue a Writ order or direction in the nature of mandamus commanding the Respondent No.1 to 5 to remove the illegal encroachment over the land Gata No.70 Rasta (Public way) and Gata No.125 situated in Village - Garhi Jaggannath Hamlet of Village Rahankala, Tehsil Etmadpur, District Agra. (b) Issue a writ order or direction in the nature of mandamus commanding the respondents to take action against the Respondent No.8 to 24 for illegal encroachment over the public utility land and initiate suitable action against the relevant laws." 2. The petitioner has relied upon a direction issued by the SDM, Etmadpur, District Agra on 14 August 2012 for the removal of an alleged encroachment under Section 133(1) of the Code of Criminal Procedure, 1973. Since the direction appears to have been issued on 14 August 2012, we direct that the fourth respondent shall scrutinize all the facts and circumstances of the case and thereafter would determine what action is necessary to secure compliance with the orders if any that hold the field. Since the private respondents are not before the Court, we clarify that any such scrutiny as we have directed shall take place strictly in accordance with law with due notice to all the affected parties. The petition is accordingly disposed of. There shall be no order as to costs.
