JUDGMENT : Petitioner wants a direction upon the respondents to grant him the benefit of B.A. trained scale with effect from 30.12.2012 since he has acquired a B.A. degree. The B.A. degree in question is not a degree equivalent to graduation in the eye of law because the degree which the petitioner claims to be equivalent to a graduation degree is said to be Sahitya Alankar degree obtained from the Hindi Vidyapeeth, Deoghar in Jharkhand. This Court has already decided in the case of Reeta Shrivastava v. the State of Bihar & others, reported in 2012 (3) PLJR 353 that the Sahitya Alankar degree is not a degree equivalent to graduation. Therefore, the said degree cannot form the basis for grant of any benefit of B.A. trained scale to the petitioner. The prayer for such a promotion is, therefore, hereby rejected. Writ is dismissed.
