body2016
JUDGMENT V.K. Bist, J. (Oral) Petitioners have approached this Court seeking the following reliefs: “I. A writ, order or direction in the nature of mandamus commanding the respondent no. 1 & 2 to provide police protection to the petitioners. II. A writ, order or direction in the nature of mandamus commanding the respondent no. 1 & 2 to ensure that respondent no. 4 to 10 shall not endanger the life and liberty of the petitioners. III. A writ, order or direction in the nature of certiorari quashing the F.I.R. dated 13/07/2016 lodged at Police Station Laksar, Haridwar against the petitioner no. 2.” 2. So far as prayer no. III is concerned, the petitioner no. 2 can approach the learned Single Judge challenging the F.I.R. dated 13.07.2016 lodged against him at Police Station Laksar, Haridwar. Therefore, the petitioners are permitted to withdraw the writ petition so far as prayer no. III is concerned for filing appropriate Writ before the appropriate Court. 3. So far as prayer nos. I & II are concerned, we are not inclined to grant relief in favour of the petitioners, inasmuch as, this Court has no jurisdiction to ask the Police of District Haridwar to give protection to the petitioners at District Saharanpur, where both the petitioners are residing. For this purpose, the petitioners are at liberty to avail appropriate remedy at appropriate forum. Consequently, the writ petition also stands dismissed so far as prayer nos. I & II are concerned. 4. Let a certified copy of this judgment be issued today itself.
