ORDER 1. In this petition, the petitioner inter alia seeks a direction to the respondents not to demolish the property of the petitioner. 2. When the matter was taken up today, learned counsel for the petitioner submits that the petitioner is the owner of the premises in question on the strength of the sale deed, however, without issuing notice to the petitioner his property is sought to be demolished. Learned counsel for the petitioner fairly submits that the petitioner has remedy of approaching the Collector under section 323 of the Madhya Pradesh Municipalities Act, 1961 and the petitioner be granted liberty to approach the Collector. 3. Shri Amit Bansal, learned Deputy Government Advocate on the other hand submits that in case the petitioner approaches the Collector, the Collector shall consider the grievances of the petitioner in accordance with law. 4. In view of the submissions made and in the facts of the case, the writ petition is disposed of with the direction that in case the petitioner files an application within one week from the receipt of certified copy of the order passed today before the Collector, Shivpuri, the aforesaid authority shall decide the application submitted by the petitioner by speaking order after affording an opportunity of hearing to the respondent No.2 within one month from the date of receipt of such application. Till the application preferred by the petitioner is decided, the construction raised by him shall not be demolished. It is made clear that this Court has not expressed any opinion on merits of the case. 5. Accordingly, the petition is disposed of. R. K.
