This intra court appeal is directed against the order dated 1.2.2016 passed by the learned Single Judge of this High Court, whereby he has dismissed appellant’s WP(C) No. 4354/2015. 4. The appellant was earlier appointed as Honorary Assistant Teacher and her services were discontinued vide order dated 24.6.2011. Aggrieved, the appellant filed WP(C) No. 457/2012 on the ground that since she has been working as Honorary Assistant Teacher for long, she be allowed to continue on that post. But, this Court did not agree with the appellant and vide order dated 3.2.2012 disposed of her WP(C) No. 457/2012 with the direction that whenever the respondents shall make recruitment on the post of Hindi Teacher, they shall also consider her case, as per the policy. 5. Now, the State Government has issued an advertisement for appointment of Hindi Teacher, but the essential qualification prescribed is TET, which the appellant does not possess. The appellant, therefore, again filed WP(C) No. 4354/2015 and the learned Single Judge has dismissed the same by the impugned order. 6. As already seen above, the honorary service of the appellant was discontinued vide order dated 24.6.2011. She, therefore, has no legal right for the regular post of Assistant Teacher, if she does not possess the prescribed essential qualification. 7. It is to be noted that appellant’s earlier petition was also dismissed with the direction that her case be considered for appointment as per the policy in vogue. Since the appellant does not possess the essential qualification of TET, we cannot direct the State Government to consider her case for appointment on the post of Assistant Teacher. The appeal has no merit and is accordingly dismissed.
