In the present Public Interest Litigation, the petitioner, who is a resident of North Kamrup (Rural), has prayed that Respondent No. 5 – M/s Eco Tech Papers, an Industrial Unit, be directed to shut down its operation permanently and that it be also dismantled. 3. According to the petitioner, the Industrial Unit M/s. Eco Tech Papers has illegally been constructed on an agricultural land and after the Unit has become functional, it is causing air and water pollution in the area, due to which, local residents are facing great hardship. 4. It is not in dispute that the Unit has been constructed on the land purchased by its owner. It is also true that construction of the Unit started in the year 2012, after the Circle Officer of Kamalpur Revenue Circle declared by a certificate dated 2.7.2011 that the land was not fit for growing crops. The Unit then went into production in the year 2014. The Unit has provided employment to large number of persons of the locality. And all these developments took before the eyes of petitioner. Still he opted to file this petition for dismantling of the Unit in the year 2015. Therefore, at this stage, when the Unit has started production, we are not inclined to direct either for its closure or removal. 5. As regards the allegation of pollution being caused by the Unit, we have examined the recent report dated 24.11.2015 submitted by Respondent No. 4 - Pollution Control Board, Assam which states that everything is well within the prescribed limit. This being the situation, we find no merit in the petition. It is accordingly dismissed.
