JUDGMENT This appeal is preferred to challenge the order dated 19.09.2014 passed by learned Single Bench in S.B. Civil Writ Petition No.6374/2014. 2. In brief, facts of the case are that the appellant plaintiffs preferred a suit for declaration as per provisions of Sections 88, 188 and 92-A of the Rajasthan Tenancy Act, 1955 before the Sub Divisional Officer, Girwa, District Udaipur. On being failed to file written statement to the plaint, learned trial court closed the right to file the same. An application dated 19.01.2004 then was preferred by the defendant to recall the order closing the right to file written statement. The application aforesaid came to be rejected vide order dated 29.09.2004. A revision petition to question correctness of the order aforesaid was filed before the Board of Revenue, Rajasthan, Ajmer and that came to be accepted on 30.04.2013. Learned Board of Revenue set aside the order passed by the original court and directed to take written statement on record subject to payment of cost in a tune of Rs.2000/-. The writ petition giving challenge to the same came to be dismissed. Being aggrieved by the same, the appellants have preferred this appeal. 3. Heard learned counsel. 4. Looking to the fact that the Board of Revenue directed the trial court only to take written statement on record and then to decide the suit on merits, we are not inclined to interfere with the order impugned. 5. In view of it, the appeal is dismissed. No order to costs.
