JUDGMENT The writ petition challenged an order of transfer by which the appellant, who is a Lekhpal, was transferred from Varanasi to Sonbhadra. 2. The learned Single Judge was justified in declining to entertain the writ petition, having due regard to the parameters of the jurisdiction under Article 226 in this regard. However, the only ground which is now urged and which may merit sympathetic consideration is that the wife of the appellant is suffering from Cancer and is undergoing treatment at Sir Sundar Lal Hospital, Varanasi. This is an aspect which has to be considered by the competent authority. We leave it open to the appellant to move the competent authority with all medical papers so that the precise line of treatment and humanitarian necessities can be considered by the appropriate authority. 3. However, we clarify that this will not amount to a stay of the transfer and the appellant must join at the place of transfer. 4. The special appeal is accordingly disposed of. There shall be no order as to costs.
