ORDER : The petitioner has sought for a Writ of Mandamus to direct the first respondent to conduct enquiry on the petitioner's representation dated 02.03.2015 and not to take any action in pursuant to the resolution dated 27.02.2015 passed by the second respondent, as the said resolution is passed without following the due procedure. 2. According to the learned Counsel for the petitioner that even though show cause notice dated 15.04.2015 was issued, to which, the petitioner has also given a reply on 09.05.2015, which has been duly served on the respondents on 11.05.2015, nothing is forthcoming from the first respondent against the reply given by him. He further submitted that in pursuant to the interim order granted by this Court, till date, he has been co-operating with the petitioner in the matter of signing the cheques. However, the only grievance of the petitioner is that in certain cheques the President of the Panchayat concerned insisted in signing the blank cheques, without any rhyme or reason, for which, the petitioner has refused to co- operate resulted in coming forward with the present Writ Petition. 3. Per contra, the learned Additional Government Pleader through his counter affidavit submitted that the petitioner has not even given reply to the show cause notice issued to him. At present, the Block Development Officer of the concerned Panchayat takes care of the bills. 4. Be that as it may, the fact remains that the petitioner wants to conduct enquiry for the representation sent by him dated 02.03.2015. It is stated that till date the said representation is pending on the file of the first respondent. Therefore, the first respondent is directed to consider the representation of the petitioner dated 02.03.2015 and pass appropriate orders, on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. It is made clear that the cheque signing power of the petitioner should not be disturbed, till the first respondent passes an order, as directed by this Court. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
